En esta norma se establece el pago de este beneficio el julio y diciembre: fiestas patrias y navidad. \u00bfQu\u00e9 pasa si la empresa no cumple con este pago?<\/p>\n<p>Este 2020 la fecha l\u00edmite para cumplir con el pago de la gratificaci\u00f3n es el martes 15 de diciembre. Los trabajadores afiliados a una EPS reciben un bono adicional de 9%, mientras que los afiliados a una EPS reciben una bonificaci\u00f3n de 6,75%.<\/p>\n<p>\u00bfC\u00f3mo actuar ante el incumplimiento del empleador?<\/p>\n<p>Si la empresa no concreta el pago de la gratificaci\u00f3n en la fecha l\u00edmite establecida por la ley, entonces el empleado puede colocar una denuncia ante la Superintendencia Nacional de Fiscalizaci\u00f3n Laboral (Sunafil).<\/p>\n<p>Lo puede hacer al d\u00eda siguiente de cometida la falta. En este caso, la ley establece multas de entre 500 y 420 mil soles. Todo depende del n\u00famero de trabajadores afectados y de la cantidad de infracciones relacionadas.<\/p>\n<p>\u00bfA qui\u00e9n le corresponde?<\/p>\n<p>Trabajadores subordinados que trabajan en empresas privadas con contrato a plazo fijo, tiempo parcial o contrato indefinido.<\/p>\n<p>Trabajadores de peque\u00f1as empresas, contratados despu\u00e9s que la empresa se haya inscrito en el Registro de Micro y Peque\u00f1a Empresa (Remype). Estos recibir\u00e1n medio sueldo de gratificaci\u00f3n seg\u00fan la Ley MYPE-TUO DS 013-2013-Produce.<\/p>\n<p>Trabajadores de la micro empresa contratados antes que la microempresa se inscribiera en el Remype.
